“မြန်မာနိုင်ငံ တရားဝင်သစ်ဖြစ်ကြောင်း အာမခံသည့်စနစ် မူကွဲ (၁.၀၃ - ၂၀၂၂)” အား ဆက်စပ်ပတ်သက်ပါဝင်သူများထံမှ လူထုသဘောထားမှတ်ချက်နှင့် အကြံဥာဏ်ရယူခြင်း”
မြန်မာနိုင်ငံသစ်တောထောက်ခံချက်ပြုရေးကော်မတီအနေဖြင့် ၂၀၀၉ ခုနှစ်တွင် “အာဆီ ယံ၏ လမ်းညွှန်ချက် တရားဝင်သစ်၏ စံနှင့်အညွှန်းများ (၂၀၀၉)”ကို အခြေခံ၍ စံ (၆) ခုနှင့် အညွှန်း(၁၅)ခု ပါဝင်သော “တရားဝင်သစ်ဖြစ်ကြောင်း ထောက်ခံချက်ပေးနိုင်ရန် မြန်မာနိုင်ငံ စံနှင့်အညွှန်းများ” ကို မြန်မာဘာသာ၊ အင်္ဂလိပ်ဘာသာတို့ဖြင့် သက်ဆိုင်ရာဌာနများနှင့် ပူးပေါင်း ၍ ရေးဆွဲခဲ့ပါသည်။
ထို့နောက် ၂၀၁၃ ခုနှစ်တွင် မြန်မာနိုင်ငံသစ်တောထောက်ခံချက်ပြုရေးကော်မတီမှ “တ ရားဝင်သစ်ဖြစ်ကြောင်း ထောက်ခံချက်ပေးနိုင်ရန် မြန်မာနိုင်ငံ စံနှင့်အညွှန်းများ−၂၀၀၉” ကို အ ခြေခံ၍ မြန်မာနိုင်ငံရှိ လုပ်ထုံးလုပ်နည်းများ၊ ဥပဒေများနှင့်အညီ “မြန်မာနိုင်ငံတရားဝင်သစ်ဖြစ် ကြောင်း အာမခံသည့်စနစ်−Myanmar Timber Legality Assurance System, MTLAS” ကို ရေးဆွဲခဲ့ပါသည်။ MTLAS တွင် ဥပဒေသ (၆) ခုနှင့် စံ (၂၀) ပါဝင်ပြီး သစ်ထုတ်လုပ်ခွင့်မှစတင်၍ သစ်များ တင်ပို့ရောင်းချသည်အထိ ပါဝင်ပါသည်။ MTLAS တွင် သစ်ရရှိသည့် အရင်းအမြစ် (Sources of Timber) နေရာတွင် သဘာဝတောမှ ထွက်ရှိသောသစ်ကိုသာ ထည့်သွင်း၍ ရေးဆွဲ ခဲ့ပါသည်။
MTLAS စနစ်အား နိုင်ငံတကာတွင် ကျင့်သုံးလျက်ရှိသော မူဘောင်များနှင့်အညီ လိုအပ် ချက်များ၊ အားနည်းချက်များကို သိရှိနိုင်ရန်နှင့် FLEGT VPA လုပ်ငန်းစဉ်အား အထောက်အပံ့ ဖြစ်စေရန် ရည်ရွယ်၍ “MTLAS Gap Analysis Project” ကို (၂၀၁၆−၁၇) ခုနှစ်တွင် EU FAO FLEGT Programme ၏ အထောက်အပံ့ဖြင့် အကောင်အထည်ဖော်ဆောင်ရွက်ခဲ့ပါသည်။
မြန်မာနိုင်ငံသစ်တောထောက်ခံချက်ပြုရေးကော်မတီသည် “Programme for Endorsement of Forest Certification-PEFC” နှင့် ပူးပေါင်း၍ “Working in Partnership to bring Sustainable Management to Myanmar’s Forest” ခေါင်းစဉ်ဖြင့် (၃) နှစ်တာစီမံကိန်းကို Prince Albert (II) of Monaco Foundation ၏ အထောက်အပံ့ဖြင့် ၂၀၁၇ ခုနှစ်၊ မေလမှ စတင်၍ အကောင်အထည်ဖော်ဆောင်ရွက်ခဲ့ပါသည်။ MFCC မှ ရေးဆွဲထားသော Policies များတွင် စနစ် များ/စံနှင့်အညွှန်းများ ရေးဆွဲသည့်အခါနှင့် ပြန်လည်သုံးသပ်ပြင်ဆင်ရေးဆွဲသည့်အခါတွင် လိုက် နာဆောင်ရွက်ရမည့် Standard Setting Policy (MFCC P 3 SS) လည်းပါဝင်ပါသည်။ ဖော်ပြပါ Policy တွင် စံနှင့်အညွှန်းများအား ရေးဆွဲပြီး (၅) နှစ်အကြာတွင် ပြန်လည်သုံးသပ်ပြင်ဆင်ရေး ဆွဲရန် ထည့်သွင်းရေးဆွဲထားပါသည်။
European Timber Trade Federation-(ETTF) ၏ အထောက်အပံ့ဖြင့် NEPcon အဖွဲ့အစည်းသည် “Evaluation of the Myanmar CoC Dossier and MTLAS” ခေါင်းစဉ်ဖြင့် ဆန်းစစ်အကဲဖြတ်မှုများပြုလုပ်ခဲ့ပြီး ၂၀၁၉ ခုနှစ်၊ ဇူလိုင်လ တွင် အစီရင်ခံစာကို ထုတ်ပြန်ခဲ့ပါ သည်။ အဆိုပါအစီရင်ခံစာတွင် MTLAS အား ပြန်လည်ပြင်ဆင်ရေးဆွဲရန် လိုအပ်ကြောင်းကို လည်း သုံးသပ်ရေးသားထားကြောင်း တွေ့ရှိရပါသည်။ ၂၀၂၀ ပြည့်နှစ်တွင် MTLAS စနစ်အား ပြန် လည်ပြင်ဆင်ရေးဆွဲရာ အဆိုပါအစီရင်ခံစာမှ ထွက်ရှိလာသော တွေ့ရှိချက်များနှင့် ၂၀၁၆−၁၇ ခုနှစ်တွင် အကောင်အထည်ဖော်ဆောင်ရွက်ခဲ့သော စီမံကိန်းမှ ရရှိသည့် တွေ့ရှိချက်များ၊ လက် တွေ့အကောင်အထည်ဖော်ဆောင်ရွက်ရာမှ တွေ့ရှိချက်များကို ထည့်သွင်းစဉ်းစား၍ အာဆီယံ၏ တရားဝင်သစ်ဖြစ်ကြောင်း စံနှင့်အညွှန်း (၂၀၁၉−မူကြမ်း) တို့ကို အခြေခံ၍ MTLAS စနစ် မူကွဲ (၁.၀၂) ကို မူကြမ်းအနေဖြင့် ရေးဆွဲခဲ့ပါသည်။
MFCC-PEFC စီမံကိန်းပြီးဆုံးသည့်နောက်ပိုင်းတွင် WWF ၏ ပံ့ပိုးမှုဖြင့် International Consultant တစ်ဦး ရွေးချယ်ငှားရမ်းခဲ့ပါသည်။ ၄င်းမှ ASEAN ကို အခြေခံပြီး ရေးဆွဲ ထားသော MTLAS 2019 ပေါ်တွင် ပြန်လည်သုံးသပ်၍ အကြံပြုခဲ့ပါသည်။ အဆိုပါအကြံပြုချက်များတွင် Legality Definition အဆိုပြုချက်လည်း ပါရှိပါသည်။ Timber Legality Definition နှင့် ပတ်သက်၍ အဓိပ္ပါယ်ဖွင့်ဆိုချက်သည် သက်ဆိုင်ရာနိုင်ငံ၏ ဥပဒေ၊ နည်းဥပဒေများနှင့် ကိုက်ညီမှု ရှိရန် လိုအပ်ပါသည်။
MTLAS ကို ပြန်လည်သုံးသပ်ရာ မူလ (၂၀၁၃) စံချိန်စံညွှန်းကို မူကွဲ (၁.၀) သတ်မှတ် ပါသည်။ မူကွဲ (၂) ကို အတည်မပြုမီ မူကွဲ (၁.၀၁)၊ (၁.၀၂)နှင့် (၁.၀၃) စသည်ဖြင့် သတ်မှတ်ရန် အဆင့်များ ရှိမည်ဖြစ်ပြီး နောက်ဆုံးမူကွဲ (၂) ကို အတည်ပြုပြီးသည်အထိ အဆင့်ဆင့်လုပ်ဆောင် ခဲ့ချက်များကို ရက်စွဲဖြင့် မှတ်တမ်းတင်ထားမည် ဖြစ်ပါသည်။ MTLAS မူကွဲ (၁.၀၁) ကို ၂၀၁၉ ခုနှစ်၊ ဖေဖော်ဝါရီလ (၂၂) ရက်နေ့တွင် အတည်ပြုခဲ့ပါသည်။ MTLAS မူကွဲ (၁.၀၂) ကို ၂၀၂၁ ခုနှစ် ဇန်နဝါရီလ ၂၆ ရက်နေ့တွင် အတည်ပြုခဲ့ပါသည်။ ယခု MTLAS မူကွဲ (၁.၀၃) သည် ၂၀၂၂ ခုနှစ်၊ ဇွန်လ (၃) ရက်နေ့တွင် ကျင်းပခဲ့သော Expert Advisory Group နှင့် ၂၀၂၂ ခုနှစ်၊ ဇွန်လ (၁၃) ရက်နေ့တွင် ကျင်းပခဲ့သော မြန်မာနိုင်ငံသစ်တောထောက်ခံချက်ပြုရေး ကော်မတီ ပထမ အကြိမ်မြောက် အစည်းအဝေးမှ အတည်ပြုထားခြင်း ဖြစ်ပါသည်။
မြန်မာနိုင်ငံသစ်တောထောက်ခံချက်ပြုရေးကော်မတီမှ ပြုစုထားသော Standard Setting Policy အရ “မြန်မာနိုင်ငံတရားဝင်သစ်ဖြစ်ကြောင်း အာမခံသည့်စနစ်” မူကွဲ (၁.၀၃ - ၂၀၂၂) ကို အတည်ပြုနိုင်ရေးအတွက် ဆက်စပ်ပတ်သက်ပါဝင်သူများ အားလုံးထံမှ သဘောထား မှတ်ချက်နှင့် အကြံဉာဏ်များ ပေးပို့ပါရန် မေတ္တာရပ်ခံအပ်ပါသည်။
သဘောထားမှတ်ချက်နှင့်အကြံဉာဏ်များတောင်းခံသည့် အချိန်ကာလမှာ ရက်ပေါင်း (၃၀) ဖြစ်ပြီး ၂၀၂၂ခုနှစ်၊ ဇွန်လ (၂၈) ရက်နေ့မှ ၂၀၂၂ခုနှစ်၊ ဇူလိုင်လ(၂၇)ရက်နေ့အထိ ဖြစ်ပါသည်။ သဘောထားမှတ်ချက်နှင့်အကြံဉာဏ်များပေးခြင်းကို “လူထုသဘောထားမှတ်ချက် နှင့် အကြံဉာဏ်ရယူခြင်းပုံစံ” တွင် ဖြည့်စွက်ပေးပို့နိုင်ပါသည်။ မြန်မာနိုင်ငံသစ်တောထောက်ခံ ချက်ပြုရေးကော်မတီ [email protected] သို့ Emailဖြင့် ပေးပို့၍ သဘော ထားမှတ်ချက်နှင့်အကြံဉာဏ်များကို ပေးပို့နိုင်ပါသည်။
လူကြီးမင်းတို့အနေဖြင့် သဘောထားမှတ်ချက်နှင့် အကြံဉာဏ်များ ပေးပို့ရန် အချိန်ကာလ ထပ်မံလိုအပ်နိုင်သည့်အတွက် သဘောထားမှတ်ချက်နှင့် အကြံဉာဏ်များ တောင်းခံသည့် အချိန်ကာလကို (၂၈-၇-၂၀၂၂) ရက်နေ့မှ (၁၀-၈-၂၀၂၂) ရက်နေ့ထိ ရက်သတ္တ ပတ်(၂)ပတ် ထပ်မံ တိုးမြှင့်လိုက်ပါသည်။
Public Consultation for “Myanmar Timber Legality Assurance System (MTLAS) Version (1.03-2022)”
In order to enable MFCC to be in the position to manage the issuance of legality certificate, the set of Criteria and Indicators was developed comprising (6) criteria and (15) indicators based on “ASEAN Criteria and Indicators for Legality of Timber (2009)” in both Myanmar and English languages with the collaboration of the related departments.
Then, in 2013, the Myanmar Forest Certification Committee developed and approved the “Myanmar Timber Legality Assurance System, MTLAS” based on the existing laws, rules and regulations as well as the “Myanmar Criteria and Indicators for Legality of Timber - 2009”. MTLAS includes (6) principles and (20) criteria, starting from right to harvest to the exports. In MTLAS, the source of timber was only covered harvested timber from natural forest.
In order to meet the international benchmarks of the legality frameworks, the MTLAS Gap Analysis Project was conducted in 2016-17 under the assistance of EU FAO FLEGT Program to identify gaps and to support FLEGT process accordingly.
In addition, Myanmar Forest Certification Committee collaborated with the Program for Endorsement of Forest Certification (PEFC) and launched a three-year project called “Working in Partnership to bring Sustainable Management to Myanmar’s Forest” funded by Prince Albert (II) of Monaco Foundation in 2017 May. During this project, MFCC developed the policies that included the Standard Setting Policy (MFCC P 3 SS) to be followed when developing systems / criteria and indicators. The policy includes to be reviewed and revised to the criteria and indicators that has been developed after five years.
With the support of the European Timber Trade Federation (ETTF), NEPcon conducted an assessment report on “Evaluation of the Myanmar CoC Dossier and MTLAS” and the report was released in 2019 July. The report also indicated that MTLAS needed to be reviewed and revised. In 2020, the findings from that report, the findings of the above 2016-17 project and the findings from the Standard Implementation Stage were taking into account of the developing of the MTLAS Version (1.02). It was also drafted based on the ASEAN Standard for Legality of Timber (2019-draft).
After the completion of the MFCC-PEFC project; with the support of the WWF, an International Consultant was selected and hired to review the MTLAS 2019, which is based on ASEAN guidelines. It also includes the recommendation to revise the Legality Definition which is also to comply with the current laws, rules and regulations of Myanmar.
When MTLAS was reviewed, the original set of Criteria and Principles (2013) is set as Version (1.0). Before the Version (2) is approved, there will be steps to be set as Version (1.01), (1.02), (1.03) and etc.; and all steps will be recorded with the date until the Final Version (2.0) is approved. MTLAS Version (1.01) was approved on 22nd February 2019, and MTLAS Version (1.02) was also approved on 26th January 2021. Now, MTLAS Version (1.03) was approved by Expert Advisory Group on 3rd June, 2022 and First MFCC Meeting on 13th June 2022.
In accordance with MFCC standard setting policy, MFCC would now like to invite stakeholders’ comments on “Myanmar Timber Legality Assurance System (Version 1.03 - 2022)”. This consultation period will open for 30 days from 28 June, 2022 and end on 27 July, 2022. Feedback can be submitted by completing the below MTLAS public consultation form. Myanmar Forest Certification Committee has extended the public consultation period for two weeks, from 28 July, 2022 to 10 August, 2022 in order to give you more time to send feedback.
